BURLINGTON, Vt. – The University of Vermont Athletic Department announced today that Todd Woodcroft has been relieved of his duties as head coach of Men's Hockey at UVM, effective immediately. Assistant Coach Steve Wiedler was named interim head coach for the upcoming season. Director of Athletics Jeff Schulman provided the following statement: "The University of Vermont Athletic Department has high expectations for the conduct of our coaches and all involved with our department. After reviewing the findings of an investigation conducted by UVM's Office of Affirmative Action and Equal Opportunity that was completed this week, it is clear that Coach Woodcroft failed to meet those expectations. The specific conduct leading to the investigation involved inappropriate text messages with a UVM student on multiple occasions that failed to maintain professional boundaries. Earlier today, I met with the Men's Hockey team to inform them of my decision and to introduce Steve Wiedler as interim head coach for the 2023-2024 season. The team and I have tremendous confidence in Coach Wiedler's ability to successfully lead our program. He has played a major role in the recruitment and development of our current players and will step into this important role with the full support of our team and his Athletic Department colleagues."

Can he sue the school on the basis that UVM having an "Office of Affirmative Action and Equal Opportunity" is now unconstitutional?

Can he sue the school on the basis that UVM having an "Office of Affirmative Action and Equal Opportunity" is now unconstitutional? It is true that race-based college admission decisions are unconstitutional (and some misreporting has equated this to the end of affirmative action and equal opportunity). His lawyer says they'll fight this. But, if there are text messages... Interestingly, his brother is the head coach of the Edmonton Oilers.

Why would an issue like this even be going to the affirmative action office?
Wouldn't it be better placed for something like "dean of students" or an office that is more tied to human resources / conduct?
Answered my own question. From UVM's website (https://www.uvm.edu/aaeo) -- "HERE YOU WILL FIND INFORMATION ON THE UNIVERSITY'S POLICIES AND RESOURCES RELATING TO SEXUAL MISCONDUCT, SEXUAL HARASSMENT, AND DISCRIMINATION AND HARASSMENT BASED ON OTHER PROTECTED CATEGORIES."

The student involved appears to get a free pass. I suppose a student has the right to have a steamy text correspondence with any adult who is willing to respond and the student is paying UVM while UVM is paying the coach to comply with professional standards of behavior.
